The story of the last week has been aggressive, and in many cases, unexpected action from US regulatory bodies. The SEC kicked off the week with a disapproval of the latest bitcoin ETF proposal from Bitwise, prompting some legal experts to wonder if any ETF would be approved under Chariman Clayton. The IRS released its first crypto tax guidance since 2014, which was immediately controversial in its suggestion that tokens from hard forks create a tax liability. Even some US senators got in on the game, sending open letters to the CEOs of Visa, Stripe and Mastercard urging them to leave Facebook’s Libra Association (which, on Friday, they did). The one bright spot in an otherwise dreary regulatory week was the CFTC formally acknowledging Ethereum’s ETH as a commodity, opening the door to new types of derivatives and other financial productions which tend to be attractive to a different category of investors.
